High Court places an interim injunction on Sekyikrom Odwira Festival

The Nsawam High Court in the Eastern Region presided over by Justice Eva Bannerman Williams has placed an interim injunction on the Odwira Festival by the people of Sekyikrom in the Region.

The interim injunction, which was placed on Friday, November 11, 2022, would last for six (6) days.

The ground durbar of the festival would have been Saturday, November 19, 2022, but for the injunction.

The applicants of the injunction are Nana Osae Nka IV, who sued as the Chief of Sekyikrom and Abusuapanyin David Kofi Owusu who sued as the Head of Oyoko Royal of Sekyikrom and all of Sekyikrom Chief’s Palace.

The defendants are Hagan Percy of Sekyikrom, the Ghana Police Service and the Attorney-General’s Department, all in the Eastern Region.

The order of the injunction signed by Justice Eva Bannerman Williams of Nsawam High Court and the Court Registrar, Emmanuel Amoako said “upon reading the affidavit in support of the motion ex-parte for an interim injunction of Abusuapanyin David Kofi Owusu of Sekyikrom Chief’s Palace in the Eastern Region on the 8th November 2022, for an on behalf of the plaintiff or Applicants and upon hearing Kwadwo Addeah Safo Esg, with Angela Obeng Sasu, Counsels for and on behalf of the plaintiffs or Applicants, it is hereby ordered that the Respondent restrained from carrying out the following”.

The court said the defendants [Hagan Percy of Sekyikrom, the Ghana Police Service and the Attorney-General’s Department, all in the Eastern Region], his servants, agents, assigns, privies, successors, contractors, workmen, and all those claiming through him from performing or celebrating of the annual Odwira Festival of the people Sekyikrom and its environs, which is advertised to commence on 14th November, 2022, through to the end of November 2022, or any other date, either before or thereafter”.

It added that “the second defendant [, the Ghana Police Service] and its allied police divisions, departments or headquarters, *(however so called) from providing any form of assistance to the first defendant from celebrating any form of festival of the people of Sekyikrom at Sekyikrom and its environs”.
The Court said, “the order remains for 6 days”.
