An Accra High Court has dismissed contempt charges brought against North Tongu Member of Parliament, Samuel Okudzeto Ablakwa, by Secretary to the Board of Trustees of the National Cathedral, Rev. Victor Kusi Boateng.
Rev. Victor Kusi Boateng filed the contempt charges through his lawyers after the MP was seen in a video refusing to be served with court processes.
He also claimed that the documents were not properly served to him by kicking them with his foot.
The court dismissed the contempt charges on Tuesday on the grounds that the bailiff was not a certified member of the judicial service.
The presiding judge, Justice Charles Gyamfi Dabkwah, also ruled that in 2021, the Chief Justice directed that writs be served only by members of the Judicial Service.
However, it was discovered that the alleged bailiff was not a member of the Judicial Service, so the process cannot be considered legitimate.
As a result, he dismissed the case, and Rev. Victor Kusi Boateng was fined GHC10,000.
The case was also dismissed on the grounds that the alleged bailiff did not follow procedures for serving a member of parliament who is on parliamentary duty or on his way to parliament, as claimed by Samuel Okudzeto Ablakwa on February 3, 2023.
In his ruling, the Judge also stated that the applicants did not prove the contempt charge beyond a reasonable doubt because there were inconsistencies in the facts presented before the court.
