Richard Jakpa’s motion to strike out charges against me is an extension of the public theatrics deployed by the third accused to discredit prosecution against him, the Attorney General’s office has said.
The Office of the Attorney General has filed an affidavit in opposition to the motion filed by Richard Jakpa.
The third accused person filed the motion on the grounds that the Attorney General had abused his office in conducting the prosecution against him.
Lawyers for the third accused in the ambulance case, Richard Jakpa, have filed an application in court for an order striking out the charges against him or, alternatively, staying the proceedings against him.
Mr. Jakpa, in his affidavit in support, says he testified on oath that the Attorney-General, Godfred Dame, has had several interactions with him, in which he has told him that he, Mr. Jakpa, was innocent and assured him of his acquittal.
He further avers that Godfred Dame has told him that the reason for his inclusion in the prosecution is to mask the real intention behind the whole trial.
He is claiming that the Attorney-General instituted the instant action because the President of the Republic and then Finance Minister, Ken Ofori Atta, were mounting pressure on him to persecute the then ranking Member for Finance and now Minority Leader, Hon. Ato Forson.
Jakpa is asking the court for an opportunity to be allowed to testify on these matters and to be cross-examined.
But the Attorney General’s Office has refuted all the claims made by Richard Jakpa.
The Attorney General argued that the prosecution however “is based on cogent evidence unearthed after painstaking investigations conducted.”
The office said “the depositions in the affidavit in support of the instant application are laden with spurious allegations which are carefully and mischievously calculated at creating unnecessary anxiety about the capacity of the court to dispense justice in this case.”
It further states that the “instant application is an extension of the public theatrics the accused persons have resorted to in a bid to discredit the prosecution of this case and cast doubt about the integrity of the proceedings in this Honourable Court, all of which the Attorney-General has so far observed utmost professionalism about, in spite of the persistent insults and abuse to his integrity by persons associated with the accused persons.”
The AG also described the application as a deceptive and desperate attempt by the applicant to halt his legitimate prosecution for his role in causing financial loss to the state through the purchase of regular vans misrepresented as ambulances.
“…Wherefore, I swear to his affidavit in opposition to the application as frivolous, vexatious and a complete waste of this court’s time,” he further stated.
