Justice Afia Serwah Asare Botwe of the Court of Appeal, sitting as a High Court Judge, has declined the motion by the accused persons in the ambulance trial to declare their prosecution a mistrial.
The judge also declined the application for an enquiry into the conduct of the Attorney-General and Minister of Justice, Godfred Dame.
She ruled that there was no legal basis to allow an inquiry into the conduct of a prosecutor.
Minority Leader, Dr. Cassiel Ato Forson, and third accused person in the case, Richard Jakpa, both filed the applications based on the stated misconducts of AG, raising issues they claim are proof of “egregious violations or attempted violations” of the accused persons right to a fair trial in violation of the constitutional responsibility “of the prosecution.”
But the judge presiding over the matter ruled otherwise.
Dr. Ato Forson filed a supplementary affidavit filed a supplementary affidavit on Monday, June 3, in support of the motion on notice for an order of mistrial, injunction, and/or stay of proceedings in the ongoing ambulance case against him and two others.
Lawyers for the Ajumako-Enyan-Esiam legislator cited a leaked tape between the Attorney-General, Godfred Yeboah Dame, and the third accused, Richard Jakpa, in which the former allegedly attempted to coach the third accused to implicate Dr. Ato Forson in the ongoing trial, for the application.
