The Court of Appeal acquits and discharges Ato Forson in ongoing ambulance case

The Court of Appeal has discharged the Minority Leader, Dr. Cassiel Ato Forson, from the ongoing ambulance case. 

The Court of Appeal’s decision has therefore overturned the previous order from the trial court, which ordered Dr. Ato Forson to present his defence.

It has also set aside the trial court’s directive, delivered by Justice Afia Serwaa Asare Botwe, which had dismissed Ato Forson’s submission of no case.

The minority leader had argued that there was no case for him to answer, but this submission was initially rejected by the trial judge. 

However, the Court of Appeal has ruled in favour of the Minority Leader.

With this decision, Dr. Ato Forson is no longer required to open his defence in the ongoing trial.

He was standing trial together with Richard Jakpa, who is a representative for Big Sea, and has been accused of causing a financial loss of €2.37 million to the state in a deal to purchase 200 ambulances for the country between 2014 and 2016.

The decision of the court was a 2-1 majority decision today (July 30, 2024).

The second highest court of the land held that the prosecution handling the case did not establish a prima facie case for the Minority Leader to answer.
