The Supreme Court has ordered the Accra High Court to reconsider the mandamus application of the National Democratic Congress in respect of 4 constituencies whose results are under dispute.
The constituencies are Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.
The court, by a 5-0 unanimous decision, ruled that the presiding judge hearing the case should have given the legal representation of the NDC a hearing on their application to be joined to the NPP’s mandamus application.
The reason of the court was that they were an interested party that would’ve been affected by the ruling.
The court, however, upheld the recollated results for Nsawam Adoagyiri and Ahafo Ano South West, leaving them unaffected by the decision.
Delivering the ruling in Accra on Friday, Justice Gabriel Pwamang, chair of the five-member panel, stated that “Since the orders that have been brought to be quashed are separate and distinct, we have decided to exercise our discretionary power to quash by certiorari, having required the peculiar circumstances of each ruling.
“Consequently, we hereby quash the orders of mandamus made for collation of results by the EC in the following constituencies: Okawkwei Central, Ablekuma North, Tema Central, and Techiman South.”
