Private legal practitioner, Mr. Kofi has advised members of the Operation Recover All Loot (ORAL) to exercise caution in their endeavours to avoid potential legal liabilities.
The lawyer cautioned the members to refrain from incidents that could trigger affected parties to initiate defamation and political persecution lawsuits against them.
He noted that the ORAL Committee has become susceptible to attacks and criticisms due to its existence being inconsistent with relevant laws of the country.
Referencing the recent seizure and subsequent return of a vehicle belonging to Omari Wadie of the New Patriotic Party (NPP), he observed that if the NPP official decides to sue the committee, each member would be held liable.
To this end, he urged them to avoid utilising the ORAL Committee for political purposes and ensure they operate within the framework of Ghanaian laws.
He emphasised that the committee must conduct thorough due diligence before pursuing individuals and accusing them of possessing state assets.
Mr. Kofi Bekai made the remarks in an interview on Nyankonton Mu Nsem on Rainbow Radio 87.5 FM.
“They should check about the route that they go. How they go about things; they shouldn’t use it as a political scheme to destroy the integrity and image of people. They should tread cautiously because there are consequences for their actions.”
He averred that the committee cannot go to court over these matters unless they turn them over to the relevant authority, who would then proceed to court and deal with the subject, adding that committee members can only present as witnesses and testify.
When questioned if those invited should respect the invitation, he stated that any invitation may not be legally binding; therefore, the individual may direct them to allow the proper institutions, such as the Economic and Organised Crime Office (EOCO) or any other body, to prove the matter.
