Davis Ansah Opoku, a Member of Parliament for Mpraeso, believes former Finance Minister Ken Ofori-Atta is not above the law in facing prosecution for alleged involvement in any offence as defined by law.
He was quick to add that the former minister should not be subjected to abuse by those seeking to prosecute him.
He condemned the raid on the former minister’s home, describing it as unfortunate.
The lawmaker stated that as a believer in the rule of law, he will not oppose the prosecution of those suspected of breaking the law, but he will insist on fairness in the process.
The MP was speaking with host Kwabena Agyapong on Rainbow Radio’s Frontline at 87.5 FM.
David Ansah Opoku stated, “Ghana is governed by laws, and if someone embezzles state funds and the Special Prosecutor has enough evidence to prosecute, I believe they have a responsibility to pursue those who are involved within the law. So I will not be the one to argue that offenders should be let off the hook because no one is above the law. However, in the same spirit, people should be prosecuted in accordance with due process. That is why I am concerned about the special prosecutor’s approach”.
He said that he was surprised that the Special Prosecutor would declare Ken Ofori-Atta a fugitive after his lawyers spoke with him about the former minister’s current situation.
”That worries me, which is why I disagree with the OSP’s approach. He is aware that the former minister has gone abroad for medical treatment. So declaring him a fugitive is unfortunate.”
”If you have evidence to support your case against him, no one is stopping you; however, you must do so in accordance with the law. Organising press conferences to declare him a fugitive when you are aware of his situation is unfair. That is my difficulty. However, in terms of the processes and any available evidence to support the allegations of embezzlement, the OSP must pursue them. At the end of the day, you must press charges, but do not abuse the procedure.”
