Suspension of CJ lawful and proper – Dr Apaak

Deputy Education Minister Dr Clement Apaak has defended President John Dramani Mahama following the suspension of Chief Justice Mrs Gertrude Esaana Torkornoo.

Contrary to opinions by critics of the president that he acted unconstitutionally, the Builsa South MP argued that President Mahama only acted in accordance with the law.

He was reacting to the suspension of the Chief Justice after a prima facie was determined based on three separate petitions filed for her removal from office.

President John Dramani Mahama has suspended her and set up a five-member committee to enquire into the petitions.

The committee is chaired by Justice Gabriel Scott Pwamang, a justice on the Supreme Court bench.

Other members are Justice Samuel Kwame Adibu-Asiedu, also a Justice on the Supreme Court bench, who was appointed in 2022.

The rest are Mr Daniel Yaw Domelevo, a former auditor general; Major Flora Bazaanura Dalugo from the Ghana Armed Forces (GAF); and Professor James Sefah Dzisah, an associate professor at the University of Ghana.

The president has been widely criticised by some critics, including members of the opposition NPP, who have accused him of undermining the powers of the judiciary.

But Dr Clement Apaak, in his opinion, defended his boss, stating categorically that he was only following the law to the letter.

He posited that whatever the President did was lawful and cannot be faulted.

He added that the critics of the president did not expect him to abandon his constitutional duty, which would also have amounted to a breach.

“The suspension of the Chief Justice is lawful and proper. Did the NPP expect President John Dramani Mahama to abandon his constitutional duty? Certainly not.”
