The Ghana Bar association (GBA) has in a resolution asked President John Dramani Mahama to release the full prima facie case established against suspended Chief Justice Gertrude Esaaba Torkornoo.
The Association a resolution passed at the GBA’s 2025 Mid-Year Conference held at the Labadi Beach Hotel in Accra on April 26, 2025 asked the President to make public the full details.
The statement said the move would promote transparency and fairness in the ongoing proceedings.
It noted that disclosing the President’s determination, which analyzed the petition and outlined the reasons for his conclusion, is consistent with established legal precedent.
The GBA stressed that the suspension of the Chief Justice was unconstitutional because the President, who is not a judge or judicial officer, exercised his discretion under Article 146(10) of the 1992 Constitution without the backing of a published Constitutional Instrument, Statutory Instrument, or Regulation, as required by Article 296 of the Constitution.
“The Ghana Bar Association calls upon the President of the Republic of Ghana to immediately release the full decision establishing a prima facie case against the Chief Justice, consistent with established precedent,” the statement read.
Aside from this proposal, the GBA is calling for the immediate enactment of clear and comprehensive regulations pertaining to matters under Article 146 of the Constitution.
Such regulations it argued are necessary to guarantee transparency, accountability, and fairness in all proceedings involving Superior Court justices, particularly in cases related to their potential impeachment or removal.
