Kofi Bekai, a private legal practitioner, has criticised Attorney General Dr Dominic Ayine for some of his public comments about the alleged scandal involving Kwabena Adu-Boahene, the National Signals Bureau’s former Director-General.
The former NSB official has been charged with stealing.
He has been charged alongside three other persons, including his wife, for stealing contrary to Section 124(1) of the Criminal Offences Act, 1960 (Act 29).
The other accused persons are Angela Adjei Boateng, Mildred Donkor and Advantage Solutions Limited.
The Attorney General, updating Ghanaians on Wednesday, April 30, 2025, after filing the charges, said Kwabena Adu Boahen orchestrated a “dubious” scheme that led to a financial loss of $7 million to the state.
Dr Ayine said the scheme involved the illegal diversion of state funds for personal and private use.
Responding to these issues on Frontline on Rainbow Radio 87.5FM, he opined that the Attorney General has no powers to pronounce guilt since that is reserved for a competent court of jurisdiction.
Mr Kofi Bekai stated that “the Attorney General has a responsibility to go to court and file the charges without making prejudicial comments.” The constitution is very clear, and you cannot declare someone guilty until a competent court of jurisdiction does so. You simply keep quiet, prosecute the individuals, and prove the allegations beyond a reasonable doubt by providing evidence to back up your claims.
He should not run any commentary to please anybody, but he should be able to prove in court that these allegations are backed by the evidence.
Investigations are conducted discreetly, which is why security personnel do not speak to the media. If you believe the individuals have done anything wrong, take them to court; the constitution also gives them the right to legal representation to defend themselves.”
