The Court of Appeal dismissed an application filed by Nana Appiah Mensah, the Chief Executive Officer of the defunct Menzgold Ghana Limited, also known as NAM1, to halt his ongoing criminal trial.
NAM 1 filed the application while his appeal against a High Court ruling ordering him to open his defence was being heard.
The High Court ordered him to open his defence in a criminal case in which he is charged with multiple offences such as selling gold without a licence, fraudulent breach of trust, defrauding by false pretence, and money laundering.
His lawyers subsequently filed an appeal at the Court of Appeal, seeking to overturn the High Court’s ruling.
Along with the appeal, they sought a stay of proceedings in the High Court pending the appeal’s outcome.
On Monday, May 19, 2025, state prosecutors prayed the appellate court to dismiss the application, arguing that it was an attempt to overreach the powers of the court and failed to establish any exceptional circumstances to justify a stay of proceedings.
A three-member panel of the Court of Appeal presided over by Justice Gbiel Suurbaareh unanimously dismissed the application.The other Justices were Afia Serwaa Asare-Botwe and Christopher Archer.
