Two individuals currently under investigation by the Office of the Special Prosecutor (OSP) concerning the Strategic Mobilisation Ghana Limited (SML) revenue-assurance contract have initiated a human rights action against the Office.
The applicants are suing the OSP over allegations that the Office photographed them while they were holding placards bearing their names.
The individuals are identified as Christian Tetteh Sottie, Managing Director of SML and former Technical Advisor to the Ghana Revenue Authority (GRA) Commissioner-General, and Isaac Crentsil, former Commissioner of the Customs Division of the GRA and currently a Manager at SML.
In their court filing, the two men contend that the OSP’s action—specifically, photographing them with name placards before any formal charges have been filed—is unlawful.
Among the reliefs sought, the applicants are petitioning the court for:
A declaration that the OSP’s action constitutes an unlawful breach of their human rights.
A declaration that any subsequent publication of the photographs would violate their human rights.
An order restraining the OSP from releasing or publishing the images.
