Strategic Mobilisation Ghana Limited (SML) has instituted legal action against the Office of the Special Prosecutor (OSP) over what it asserts was an unlawful search operation conducted at its offices.
The company is seeking the immediate return of the seized equipment and is claiming damages exceeding $28 million.
In its statement of claim filed before the High Court, SML states that on June 10, 2025, OSP officers, acting under a purported warrant, conducted a “heavily militarised and intrusive” search at its premises.
During this operation, they seized various assets, including servers, laptops, storage devices, and specialised mineral analysis equipment.
SML asserts that the seized equipment is integral to Ghana’s petroleum and solid minerals monitoring systems.
The company contends that the OSP’s action caused a nationwide collapse of its secure data communication network linking 25 petroleum depots, leading to a complete cessation of real-time data transmission.
It further disclosed that the seized servers contain proprietary software and firmware essential for monitoring and authenticating transactions within Ghana’s petroleum and mining sectors. SML argues that the abrupt removal of its systems permanently invalidated security protocols and rendered the infrastructure inoperable.
According to SML, the OSP’s actions constitute a breach of standard forensic and evidence-handling protocols.
The company argues that investigators physically removed the hardware rather than conducting a forensic imaging process, which would have preserved data integrity and business continuity. SML also alleges that the OSP disabled its CCTV system during the operation to obstruct video documentation.
SML is therefore petitioning the court to declare the OSP’s detention of its property unlawful and to order the immediate return of all seized equipment.
The company is also seeking financial compensation for all incurred losses, in addition to legal costs.
The Office of the Special Prosecutor has not yet filed a formal response to the claim.
SML previously provided data analysis, revenue assurance, and real-time monitoring services to the Ghana Revenue Authority (GRA), but its contract was terminated following detected breaches identified during an earlier OSP investigation.
