The Kumasi High Court has recognised both Priscilla Ofori Atta aka Odo Broni and Akosua Serwaa Fosuh as legitimate spouses of the late Ghanaian highlife musician Daddy Lumba.
According to the court, Akosua Serwaa was unable to provide original marriage certificates of the purported civil marriage between Daddy Lumba and the plaintiff.
The court received extracts, not a certified marriage certificate.
The court ruled that Akosua Serwaa failed to provide the original marriage certificates of the alleged civil marriage between Daddy Lumba and the plaintiff.
The presiding judge, Dorinda Smith Arthur, ruled that under Ghanaian family law, simultaneous customary and civil marriages are redundant, as each is independently valid.
Pursuant to the court’s ruling, the two women have been afforded marital rights and recognition in funeral, estate, and widowhood rites.
The ruling followed a lawsuit filed by Akosua, who claimed to be the musician’s sole lawful spouse, based on a 2004 civil marriage in Germany, which the defence disputed.
