An Accra High Court has issued an injunction, filed by the late musician Daddy Lumba’s maternal family, to halt the final funeral rites.
The court has restrained Kofi Owusu, the family head (Abusuapanyin) and first respondent, from proceeding with the burial.
Additionally, Transitions Funeral Home, the third respondent, has been barred from releasing the body until the substantive matter is resolved.
The court noted that affidavits presented suggested the immediate family had been excluded from funeral arrangements and emphasized the need to consider the case’s merits.
The judge acknowledged potential increased costs due to the delay but prioritized due process and proper family involvement. While affirming the family head’s authority to lead funeral preparations, the court stipulated that this authority must be exercised in consultation with the immediate family. Consequently, the court directed the first respondent to convene a stakeholder meeting within three weeks to agree on a new burial date.
Additionally, it ordered that all funds raised for the funeral be kept separate from the Daddy Lumba Memorial Foundation’s accounts.
The applicants were instructed to file an affidavit with the court registrar.
