“He will get a fair trial”: AG Ayine responds to concerns from Ofori-Atta’s US legal team

Attorney-General and Minister of Justice Dr Dominic Ayine has disclosed that former Finance Minister Ken Ofori-Atta will get a fair trial upon his return to Ghana.

According to him, he has communicated this to John Ashcroft, the lawyer and former United States Attorney General, who is representing Ken Ofori-Atta in the United States.

He made the remarks in an interview on Joy News on Saturday, January 10, 2026.

He stated that the lawyer had called to ask him if his client would be given a fair trial upon his arrival in Ghana.

Dr Ayine said Ofori-Atta would be given a fair trial in accordance with the laws of Ghana.

The minister asserted that his announcement that Ken Ofori-Atta had hired top lawyers was taken out of context to mean that he was afraid of the top lawyers.

He further explained that it was not going to be an easy battle to bring him home.

Dr Dominic Ayine said that John Ashcroft, the former Attorney-General of the United States, called me and said he was the one representing Ken Ofori-Atta in the matter. The reason he called me was to assure him that when Ken is returned to Ghana, he will get a fair trial, and I assured him that under this government and in accordance with Article 19 of the constitution, his right to a fair trial is guaranteed.”

He stressed that Ofori-Atta will be accorded due process of law.

He further revealed that Ken Ofori-Atta did not overstay his visa in the United States, as widely speculated, but had it formally revoked by the US State Department.

“I want Ghanaians to know that he just didn’t overstay his visa. The visa was actually revoked,” Dr Ayine said. “They gave him up to November 29 of 2024 to leave the United States. He did not.”

He stated that the US authorities initially planned to arrest the former minister on January 4, 2026, but that did not materialise.

He was eventually arrested on Tuesday, January 6, in the Virginia area and taken into custody.

“This is not exactly about immigration. His visa is not expired. It expires in February. No, it was revoked. I am telling you this on authority,” he added.
