The Office of the Special Prosecutor (OSP) has announced that it provided investigative and evidentiary assistance to United States law enforcement, leading to the conviction of former Tema Oil Refinery (TOR) Managing Director Asante Kwaku Berko in New York.
Berko, a dual citizen of Ghana and the US who also served as an Executive Director at Goldman Sachs, was convicted by a federal jury in Brooklyn on 6 August 2026.
He was found guilty of conspiring to pay and paying over $1 million in bribes to several Ghanaian officials between 2014 and 2015 to secure the development and financing of a power plant in Ghana.
The transaction involved the Republic of Ghana and Aksa Enerji Uretim A.S., a Turkish energy firm and Goldman Sachs client.
The OSP’s support to the Federal Bureau of Investigation (FBI) was extended through Ghana’s mutual legal assistance framework.
Acknowledging the contribution, the United States Department of Justice (DoJ) noted that the Ghanaian anti-graft body provided “significant assistance to this prosecution.”
Berko faces a maximum sentence of 30 years in prison, with sentencing set for 10 November 2026.
Highlighting the impact of joint cross-border anti-corruption efforts, the OSP emphasized the strength of international legal frameworks.
“The cooperation between the FBI and the OSP on this case occurred behind the scenes, and its public outcome of a successful prosecution is a testament to the importance of mutual legal assistance,” the OSP stated.
