The Deputy Attorney-General and Minister of Justice, Srem Sai, has revealed that the state has filed an appeal at the Supreme Court challenging the Court of Appeal’s decision to suspend the criminal trial involving Hanan Aludiba and Faiza Seidu.

The move follows an order issued by the Court of Appeal on Monday, which halted proceedings in the case involving the two accused persons.

In a social media update on the progress of the case, the Deputy Attorney-General explained that the state took the matter to the apex court because the legal framework does not permit the suspension of a criminal trial merely on account of complaints raised by an accused person regarding allegations on a charge sheet.

He emphasised that the suspension was particularly unacceptable given that the objections raised by the accused persons had already been evaluated and dismissed as lacking merit.

Highlighting the wider implications of the ruling, Srem Sai warned that allowing the decision of the Court of Appeal to remain unreversed would set a dangerous legal precedent capable of crippling criminal prosecutions across the country.

He noted that if such a precedent were allowed to stand, any accused person could easily stall or suspend their trial simply by filing complaints against items contained within their charge sheet.
