NHIA sets up historic Disputes Body under Act 852

Ghana’s National Health Insurance Authority (NHIA) has taken a decisive step to strengthen transparency and stakeholder trust by swearing in its inaugural Adjudication Committee at its Head Office in Accra.

The 10-member panel, established under Section 106 of the National Health Insurance Act, 2012 (Act 852), represents the first practical implementation of the legal dispute-resolution framework since the law was passed over a decade ago.

Chaired by retired Superior Court Judge, Justice Abdul Yusif Asibey, the newly inaugurated body is tasked with delivering fair, impartial, and swift resolutions to grievances within the National Health Insurance Scheme (NHIS).

The committee brings together a broad range of regulatory, legal, and medical expertise. Its members include Dr Alex Peasah Koduah (Medical and Dental Council), Professor Vida Yakong (Health Facilities Regulatory Agency), Joyce Adu, Esq. (Institute of Chartered Accountants), Pharm. Samuel Antwi Kwakwa (Pharmacy Council), Nelly Bernice Wallace, Esq. (Department of Social Welfare), Mrs Sophia Gifty Wiredu (Nurses and Midwives Council), and Dr Senanu Kwesi Djokoto, Deputy CEO in charge of Operations at the NHIA.

Inaugurating the committee on Monday, October 26, 2026, the Chairman of the NHIA Governing Board, Mr Lawrence Nii Okantey Adjetey, Esq., highlighted the milestone nature of the occasion.

“Today, we inaugurate the Adjudication Committee established under Section 106 of the National Health Insurance Act, 2012 (Act 852). For the first time since the Act was passed, the Authority is giving practical effect to the adjudicatory mechanism the law envisaged.”

“On behalf of the NHIA Governing Board, I express our appreciation to the Hon. Minister for Health, Kwabena Mintah Akandoh, for constituting the Committee,” Mr Adjetey said.

Addressing the panel, Mr Adjetey stressed that while disputes are inevitable in managing a central healthcare financing body, public trust will hinge on how those conflicts are handled. He charged the committee to set high institutional benchmarks, uphold strict confidentiality, avoid conflicts of interest, and operate without fear or favour.

The NHIA Management has also pledged its full backing to ensure the committee operates independently and effectively. In a speech delivered on his behalf by the Deputy CEO for HR and Administration, Mr Raphael Segkpeb, Esq., Chief Executive Dr Victor Asare Bampoe affirmed that the leadership welcomes external scrutiny over contested decisions regarding provider accreditation, member benefits, and claims processing.

“In the course of its work, the Authority takes decisions that bear directly on providers, beneficiaries and other stakeholders. These include decisions on members’ benefits, the processing of claims, the grant or withholding of accreditation, and the determination of entitlements.

“While the majority of these decisions will be sound, some will inevitably be contested. An institution confident in the quality of its work should welcome a credible forum in which such decisions can be examined, and Management therefore welcomes the establishment of this Committee.

“In that regard, Management makes three commitments. First, the Committee will be provided with the records, information and officers it requires, promptly and in full.

“Second, Management will respect the Committee’s determinations and give effect to them without delay.

“Third, no officer of the Authority will be permitted to seek to influence the outcome of any matter before the Committee,” he added.

Accepting the mandate, Justice Asibey thanked the Minister for Health, Kwabena Mintah Akandoh, and the NHIA Management for the opportunity, assuring the public that the committee will deliver legally sound and unbiased decisions.
