SML Deal: Top GRA official arrested for obstruction of justice, corruption and corruption-related offences

The Office of the Special Prosecutor (OSP) has arrested the acting Head of Legal at the Ghana Revenue Authority (GRA), Freeman Sarbah.

According to the OSP, Mr. Freeman Sarbah is under investigation for suspected corruption and corruption-related offenses.

He has also been accused of obstructing justice in respect of the GRA–Strategic Mobilisation Ghana Limited (SML) revenue assurance contract. Just last week, the OSP announced plans to drag some individuals before court in connection with the SML saga.

Those expected to face charges include former Finance Minister Ken Ofori-Atta, former GRA Commissioner-Generals Dr. Ammishaddai Owusu-Amoah and Emmanuel Kofi Nti, as well as other senior GRA officials and former advisors at the Finance Ministry.

Meanwhile, the OPS has disclosed that Ghana has saved more than GHS 2.6 billion and US$173 million from the cancellation of the upstream and mineral sector components of the Strategic Mobilisation Ghana Limited (SML) revenue assurance deal.

It stated that the savings are in addition to the GHS 1.2 billion already reported after the main SML contract was terminated.

The OSP explained that the additional savings, arose from avoiding payments tied to crude oil and gold export monitoring services that were never implemented.

“These contracts, which were based on a variable fee structure linked to exports of crude oil and gold, would have cost the State approximately US$173 million for crude oil and GHS 2.6 billion for gold exports over five years,” the OSP said in its statement.
