Srem-Sai Rejects Dame’s “Abuse of Process” Claims, Cites Fresh Evidence in NAFCO Case Withdrawal

Deputy Attorney General Justice Srem-Sai has dismissed criticisms from former Attorney General Godfred Yeboah Dame regarding the withdrawal of charges in the National Food Buffer Stock Company (NAFCO) case.

Representing former CEO Hanan Abdul-Wahab Aludiba, Mr. Dame labeled the May 5, 2026, discontinuation of charges against his client and the client’s wife as an abuse of legal process that undermined the integrity of Ghanaian law enforcement.

Responding on May 7, Dr. Srem-Sai argued that the withdrawal followed standard criminal procedure necessitated by the discovery of fresh evidence.

He emphasised that the prosecution must interrogate the accused regarding new findings before finalizing charges. Asserting that the move was both ethical and routine, he noted:
“You cannot just come to court when you have fresh evidence in a criminal trial and start throwing around the evidence. You need to hear from the accused persons regarding the fresh evidence. That will inform your final decision whether you will charge the person or not. But to say that fresh evidence is not available merely because you don’t have it is completely improper and unethical.”

Despite the current withdrawal, Dr. Srem-Sai maintained that the state remains confident in its prosecution. He clarified that the interrogation is a prerequisite to determining if the new information warrants additional charges or strengthens the existing case. Questioning Mr. Dame’s public outcry, he noted:

“We are still confident that we have a strong case against the accused person, there is no doubt about that. A fresh evidence means you have discovered something new. Whether that will lead to a new charge or beef up the old case is why we need to interrogate the accused person to hear his side of the story. It is part of criminal procedure to do that whenever you have fresh evidence. I don’t know why this has become an issue for the former Attorney General, who should know better, to be lamenting across the media, making the same point.”
