Policy Advisor for the Progressive People's Party (PPP), Kofi Asamoah Siaw has said that they are have not received any letter on why the Electoral Commission (EC) disqualified their candidate.
According to him, the reason(s) given by the EC is unclear and they would want to have the full clearance to inform their next line of action.
Kofi Asamoah Siaw posited that, the EC cannot disqualify their candidate because its impossible.
According to the EC, Dr. Nduom’s nomination could not be accepted because the number of subscribers to his forms did not meet the requirements of Regulation 7 (2) (b) of CI 94. The details are as follows:
One subscriber Richard Aseda (‘Asida’ on the Voters’ Register), with Voter ID no 7812003957) endorsed the forms in two different districts (pages 21 and 39).
The subscriber was found to be on the Voter’s Register in one district thereby disqualifying his second subscription and reducing the total number of subscribers to below the minimum required by the Law.
The same subscriber (Richard Aseda (‘Asida’) endorsed the form with different signatures in both portions of the nomination form. This raises questions as to the legitimacy of one or both signatures.
But Kofi Asamoah Siaw in an interview with Kwame Tutu on Frontline on Rainbow Radio 87.5Fm said, an invalid form cannot be used for the disqualification of a candidate, and the 1992 constitution has stated clearly how a candidate could be disqualified.
He hinted that they will seek legal action against the Commission if they fail to state clearly what warranted their disqualification.
''It is not possible for the PPP not to contest in this year's presidential election. Charlotte Osei erred in disqualifying us. She should read the law properly. The EC is not the final institution to decide on this matter and so we will need an official documentation from the Commission and after that, we will know what to do.''
He added that the C1 94 mandates the EC to notify candidates if they had problems with their forms but she failed to do so. ''If the EC does not rescind its decision on the disqualification, then the election will not come on. This is a bogus decision, he added.
