A spokesperson for the legal team of former President John Dramani Mahama has been cautioned by the Supreme Court to be mindful of his behaviour in the courtroom.
During sitting on Wednesday, January 20, 2021, the panel chaired by Chief Justice Anin Yeboah expressed displeasure at the gestures of the former Deputy Attorney-General.
According to the court, they have monitored him and realized he always makes comments when the Bench engages Counsel for the petitioner.
“Lawyer Ayine, please you are a senior member of the court. When the Bench engages Counsel, you don’t sit down and make gestures as if you are part of the legal team. I have been watching you; please this is not fair. The other time we heard you clear when an objection was taken.”
Mr. Ayine was warned not to repeat his behaviour again.
He then apologised to the court.
The summary of issues to be determined by the court are:
Whether or not the petition discloses any reasonable cause of action
Whether or not per the data available any candidate obtained more than 50% of the votes cast
Whether or not the second respondent obtained more than 50% of the votes cast by the exclusion or inclusion of Techiman south constituency results
Whether or not declaration was in violation of the constitution
Whether or not the alleged vote padding affected the results as declared.
Orders
Petitioner to file witness statement by January 21
Respondents to file same by 22nd
They are also to file the legal argument related to the initial objection by 25th (all sides)
Hearing has been fixed for 26th January.
