Lawyers of former President John Dramani Mahama has filed a motion for review of the ruling to dismiss the interrogatories they filed and argued on yesterday.
At sitting today, lawyer Tsatsu Tsikata who arrived in court late apologized to the panel and informed than that his lateness was due to the fact they were at the registry to file a motion for review.
This has forced the panel to go on recess following the decision by the petitioner to file for a review.
The Supreme Court on Tuesday, January 19, 2021, dismissed a motion filed by former President to serve interrogatories on the Electoral Commission (EC).
The basis for the application according to the petitioner was to assist the Court to narrow issues for the trial of the 2020 presidential petition.
However, the court dismissed the motion on grounds that the applicant failed to establish the relevance of the interrogatories.
“Interrogatories under Common Law is discretionary, it should be granted or refused when all the circumstances are taken into consideration. It should be noted that the questions seek to elicit answers to the issues raised by and the reliefs sought in the Petition. Interrogatories must be relevant to the issues and relate to the matters in controversy between the parties, in this case, the Petitioner and the 1 st Respondent.”
Meanwhile, Mr. John Dramani has also filed a motion requesting to inspect documents and make copies of the same.
Mr. Mahama in his motion filed is requesting the originals of the Constituency Presidential election results collation forms (Form 9) for all constituencies.
He is also requesting the originals of the Consistency Presidential Results Collation Forms (Form 9) for all constituencies in Ghana and the originals of the Constituency Presidential Election Results Summary Sheets (Form 10) for all constituencies in Ghana.
The presidential candidate who is challenging the declaration by the EC is further demanding the originals of the Regional Presidential Election Results Collation Sheets (Form 11) for all regions, the originals of the Regional Presidential Election Results Summary Sheets (Form 12) for all regions in Ghana, the originals of the Declaration of the Presidential Results (Form 13) and the records of the alleged update to the purported declaration of the presidential election results on 9th December 2020, of the results of four (4) constituencies in the Greater Accra Region.
He wants the EC to produce the documents in three (3) days of the service of notice.
