‘Minority’s injunction application on E-Levy an exercise in futility’- Majority

The Majority Leader, Osei-Kyei-Mensah Bonsu, has mocked the Minority for their decision to file an injunction application at the Supreme Court seeking to stop the implementation of the Electronic Transaction Levy (E-Levy).

Addressing a press conference on Friday, April 22, 2022, he described the move as an exercise in futility.

He explained that it behoves the Minority to provide substantial evidence to their claim.

“The burden of proof lies on the Minority to go to court and prove their case. No Supreme Court anywhere indulges in processes and procedures relating to Parliament. It is the reason why when they took a vote on the supposed rejection of the budget statement, they pushed for a division. They [Minority] pushed themselves into a labyrinth.”

”We’ve been told they have filed an injunction…You heard the Finance Minister indicate to us that the commencement of the collection of the levy is going to begin on May 1, 2022. They [Minority] want to stop the implementation. I don’t know what they mean by that. The bill is already being implemented. Upon the assent of the President, a bill; if Parliament has not postponed the operation of the bill, immediately after the assent, it comes into operation.”

”This bill is in operation. The necessary structures are being put in place now. It doesn’t mean it is not being implemented,” he stressed.

The Minority in Parliament has filed an injunction application at the Supreme Court in Accra against the implementation of the E-Levy pending a determination of its substantive case currently before the apex court.

The court has, however, scheduled the hearing of the case for May 4, 2022, three days after the planned date for the implementation of the levy.
