Petition filed against Jomoro MP thrown out

The Sekondi High Court has dismissed the petition filed against Dorcas Affo-Toffey, Member of Parliament for the Jomoro constituency.

The court presided over by Justice Dr. Richmond Osei Hwere, ruled that the MP was eligible because she lost her Ivorian citizenship at the same time she obtained her Ghanaian citizenship.

Joshua Emuah Kofie filed the application, which questioned the MP’s eligibility to run as a representative of the people in the constituency on the ticket of the National Democratic Congress (NDC).

The MP, according to the applicant, has multiple nationalities, including American and Ivorian citizenship, which is a violation of the 1992 Constitution.

Dorcas Affo-Toffey was later ordered by the Court to produce documents relating to her alleged loss of Ivorian citizenship.

However, the MP allegedly failed to comply with the court’s order, prompting the applicant to file contempt charges against her after she allegedly failed to appear in court and provide the necessary documents proving her renunciation of the alleged dual citizenship.

Counsel for the MP, Godwin Edudzi Tamakloe, pleaded with the court to dismiss the contempt case and asked for forgiveness, noting that his client had no intention of disobeying the court’s orders.

Bright Okyere Agyekum, the petitioner’s lawyer, asked the court to award a cost of GHC 20,000 against the MP for disobeying the court’s orders and wasting their time before dismissing the contempt case.

After her lawyer pleaded that his client could not afford the amount requested by the petitioner’s lawyer, the court presided over by Justice Sedinam Agbemava struck out the case and awarded a cost of GH5000 against the MP.
