The appointment of a new chief by Mahama is a willful violation of the Constitution of Ghana – PNP

The National Chairperson of the National People’s Party (PNP), Madam Janet Asana Nabla, has leveled serious accusations against President John Mahama, asserting that he has acted in willful violation of the Constitution of Ghana.

Madam Nabla contended that the President’s conduct has “brought the high office of President into disrepute, ridicule, and contempt.”

The basis for her strong assertions rests on the politically motivated removal of Chief Justice Gertrude Torkornoo, which she claims constitutes a clear breach of the Constitution.

The PNP Chairperson argued that the former Chief Justice had previously raised significant concerns that a prima facie case, as required by law, was never determined in the process seeking her removal.

Madam Nabla further stated that the former Chief Justice was denied a fair hearing, alleging that the process was “rushed and intentionally skewed to destroy the super court judge.”

During an appearance on the ‘Frontline’ program on Rainbow Radio 87.5FM, Madam Nabla characterised President Mahama’s behavior as that of an autocrat who acts as if he is “above the laws of the Republic of Ghana.”
She slammed the President, accusing him of disrespecting the Constitution and undermining the democracy that the nation has preserved for years.

Madam Nabla stated categorically that President Mahama, “like any Ghanaian, is not above the law.”

“Chief Justice Gertrude Torkornoo had raised fundamental issues about the process used in removing her from office. She had complained that due process was not followed. A prima facie case was not even established against her as required by law. She has therefore headed to court challenging her removal, which is the right thing for her to do. She is in court, and yet the President appoints a new Chief Justice to be vetted by Parliament. So, is President Mahama now above the law or the Constitution?”

Madam Nabla further expressed outrage over the perceived disrespect for the legal process:”The President is not above the law, and yet he and his assigns are treating this as a joke. This is not how we run a democracy. President Mahama is not above the Constitution of Ghana. The Attorney General is making a mockery of what is happening. President Mahama is making himself out as someone above the law.”
