The Director of Communications and Strategic Partnerships at the Cyber Security Authority, Benjamin Avornyotse, has stated that individuals who circulate nude pictures or videos of others can be prosecuted and, if convicted by a competent court, may face a three-year jail term.
He made this known in a recent interview with Rainbow Radio 87.5FM Ghana and 92.4FM UK, emphasising that circulating such photos or videos constitutes a criminal offence, and therefore, the Ghanaian public should refrain from engaging in this behaviour.
He explained that Section 67 of Ghana’s Cybersecurity Act, 2020 (Act 1038), criminalises the non-consensual sharing of intimate images or visual recordings with intent to cause serious emotional distress, making it punishable by 1 to 3 years in prison.
The law, he noted, deals with those who intentionally distribute such material, defining serious distress as mental or physical reactions like shock, humiliation, grief, or pain.
He said it’s an offence to leak somebody’s intimate videos or photos online without their consent. Even if it is an adult and you were in a relationship and the relationship is over and you threaten to leak an intimate video or photos of the individual, that is an offence under the Cyber Security Act, and if reported and you are arrested, you will be prosecuted, and the maximum sentence for such offences is three years.
He therefore advised individuals to desist from such acts.
“So those individuals that are in the habit of sharing intimate videos because they have issues with them online must be mindful because under the current act, that is an offence.”
