Governance Hub Warns Ghana’s Democracy is at Risk Amid Crackdown on Dissent and Misuse of Bail System

Growing concerns over the health of Ghana’s democracy have taken center stage following a sharp critique of the current administration’s handling of political dissent and the judicial process.

In a strongly worded statement, the Smart Generation Governance Hub has raised an alarm over an escalating trend of arrests and prosecutions targeting appointees and affiliates of the previous administration under President John Dramani Mahama, who took office on January 7, 2025. The civil society organization questions whether the nation is actively losing its long-cherished democratic credentials to partisan interests.

While acknowledging the administration’s mandate to pursue economic and social policy initiatives, the group highlights an emerging pattern that threatens the democratic foundations of the Republic.

The core of the breakdown centers on the criminalization of free speech—contrary to Article 21 of the 1992 Constitution—and the weaponization of the bail system against perceived political opponents.

“Freedom of speech is a fundamental pillar of every democratic society,” stated Rev. DK Odei-Appiah, Executive Director of the Smart Generation Governance Hub. “Although this right must be exercised responsibly, it should never be suppressed through arbitrary arrests or intimidation. Equally, bail is intended to serve as a temporary legal mechanism to ensure the appearance of accused persons before the courts and not as a punitive instrument.”

According to the organization, recent law enforcement actions suggest individuals are being arrested over comments, opinions, and public statements that pose little to no actual threat to national security. This heavy-handed approach creates a dangerous public perception that dissenting views and political criticism are systematically being treated as criminal offenses.

The group also pointed to troubling reports of excessively harsh and unreasonable bail conditions imposed by investigative and prosecutorial agencies. These actions risk turning the bail process into a political tool used to intimidate, frustrate, and silence those who disagree with the government.

The consequences of these actions extend far beyond individual cases. The selective application of arrests and bail conditions directly weakens public confidence in the independence and credibility of state institutions, particularly law enforcement and the judiciary.

Furthermore, the growing fear surrounding public expression creates a chilling effect on free speech, potentially forcing journalists, activists, and ordinary citizens into self-censorship.

“The misuse of bail conditions also undermines the constitutional principle of the presumption of innocence,” Odei-Appiah noted, warning that excessive or unrealistic requirements effectively punish individuals before they have been proven guilty in a court of law.

If left unchecked, these developments threaten to deepen political polarization, heighten public tension, and foster authoritarian tendencies entirely inconsistent with Ghana’s democratic traditions and international reputation.

“The combined effect of criminalizing free speech and weaponizing the bail system is the intimidation and suppression of political opposition and dissenting voices,” Odei-Appiah emphasized. “Such actions undermine the very principles upon which democratic governance is founded.”

In response to the shifting political atmosphere, the Hub is calling directly on the Government of Ghana, the Office of the Attorney-General, and all relevant state institutions to take immediate steps to safeguard constitutional freedoms.

The organization maintains that for Ghana to preserve its democratic reputation, its governance must remain firmly anchored in justice, fairness, accountability, tolerance, and absolute respect for fundamental human rights.
