Two failed bail applications by the Member of Parliament (MP) for Asante Akyem North, Ohene Kwame Frimpong, are likely due to Dutch authorities considering him a flight risk, according to private legal practitioner Richard Nii Amarh.
The Executive Director of the Centre for Legitimacy and Rule of Law explained that if the embattled MP were granted bail and returned to Ghana, it would be exceptionally difficult for the United States to extradite him to face trial.
His remarks follow disclosures by Rockson-Nelson Dafeamekpor, South Dayi MP and Majority Chief Whip, who revealed that two bail applications submitted on Frimpong’s behalf were rejected in the Netherlands. The lawmaker remains in custody pending an extradition hearing scheduled for 18 November 2026.
Speaking on Nyankonton Mu Nsem on Rainbow Radio 87.5FM, Mr Amarh noted that courts evaluate multiple factors, including the severity of the allegations and the likelihood of absconding, before making a bail determination.
“There are several considerations by the court in granting bail. The first thing a court may consider would be the gravity of the offence, the charges, the number of years of punishment available for such an offence. In the situation of the Honourable, what may have worked against him is that he is considered a flight risk. He is being prosecuted abroad, and if he is granted bail and he returned to Ghana, it would be difficult for him to be extradited; that is why his bail may have failed.”
Addressing the nature of the charges and their implications, Mr Amarh stated that the MP faces allegations involving a romance scam alongside other offences, noting that potential legal outcomes vary depending on the prosecuting jurisdiction.
He further highlighted the broader impact of Frimpong’s continued detention on both the country and his constituency, referencing past cases to illustrate that such delays are common in complex extradition proceedings.
The primary challenge, he stressed, is that constituents in Asante Akyem North are left without parliamentary representation while their MP faces criminal prosecution outside Ghana.
He added that Parliament appears hesitant to act decisively on the matter, likely holding out hope that the MP may yet resolve his legal troubles.
