Semen-stained garment strongest evidence in Obuasi SHTS sex abuse case – Legal practitioner

Private legal practitioner and Head of Legal for the Centre for Legitimacy and Rule of Law, Richard Nii Amarh, has asserted that clothing allegedly containing the semen of the interdicted headmaster of Obuasi Senior High Technical School could serve as the strongest evidence in the ongoing sex abuse scandal.

He emphasised that the alleged sexual offences involving 19 victims are grave, requiring the law to take its full course to ensure the victims secure justice. Speaking in an interview on Nyankonton Mu Nsem on Rainbow Radio 87.5FM, Mr Amarh indicated that investigations into the matter could be conducted professionally and expeditiously without unnecessary delays.

He stressed that if the police are dedicated to the case, thorough investigation and prosecution should proceed swiftly, noting that law enforcement has no reason to delay given that the victims have already been identified and their statements can easily be taken.

“Investigations into criminal offences are distinct from the adjudication process. In my view, if the police were fully committed, their investigation should already be wrapping up, as the victims are already known. They must take the victims’ statements, secure all relevant evidence, and verify it. I have gathered that one of the victims possesses material containing the interdicted headmaster’s semen. That garment is key evidence requiring DNA and forensic analysis. Whether the police have conducted these tests remains unknown,” he said.

Mr Amarh noted that the case will eventually proceed to the High Court for adjudication once the necessary evidence is presented. He explained that if all 19 victims agree to testify, the court proceedings may take some time, as each victim would need to give evidence and face cross-examination by the defence.

The lawyer further urged that the welfare, safety, and personal dignity of the affected students must remain the top priority for authorities. He stressed that handling the case demands sensitivity, strict confidentiality, and a well-coordinated approach tailored to each individual’s needs.

He added that for any victims under the age of 18, proceedings will not be held in open court but in the chambers of the presiding judge, with police prosecutors required to appear in plain clothes.

“If that material containing the semen of the interdicted headmaster exists, and testing yields a positive result, then in my legal view, little else would be needed to prosecute the matter. That alone would constitute sufficient evidence to prove he sexually abused the victim,” Richard Nii Amarh maintained.
