High Court halts trial of ex-NSB boss Kwabena Adu-Boahene over Supreme court injunction application

The Accra High Court has paused the trial of former National Signals Bureau (NSB) Director-General Kwabena Adu-Boahene and his wife Angela Adjei-Boateng until 25 August 2026.

Presiding judge Justice Francis Apangabuno Achibonga ruled that the court must pause proceedings while an application to stop the court from sitting during the legal vacation remains pending before the Supreme Court. The top court will hear the injunction request on 20 August 2026.

Mr Adu-Boahene faces charges including fraud, causing financial loss to the state, and misuse of public office over the alleged theft of GH¢49.1 million meant for a cyber-defence system. His wife faces related charges, including money laundering and conspiracy. Both deny all allegations.

Defence lawyer Peter Osei-Asamoah, holding brief for lead counsel Samuel Atta Akyea, asked the trial judge to pause the case. He explained that Mr Atta Akyea had other professional duties during the recess, and proceeding without him would breach the accused persons’ constitutional right to legal representation. He added that the court should wait for the Supreme Court’s decision on the injunction.

Deputy Attorney-General Dr Justice Srem-Sai opposed the pause, arguing that other lawyers from the defence firm could represent the couple. He also stressed that simply filing a court application does not automatically halt trial proceedings.

Justice Achibonga rejected the defence’s request to delay the trial until October, stating that such a long break would defeat the purpose of his warrant as a vacation judge. However, he agreed that a lower court should not proceed while a higher court considers whether to block the trial. He therefore adjourned the case to 25 August 2026 at 9:30 am.
