Lead Counsel for petitioner John Dramani Mahama has described the questions posed to Asiedu Nketiah by Justice Yaw Appau when he mounted the witness box as irrelevant.
He said these questions were irrelevant because they did not form the basis for the petition filed by the petitioner.
The justices on the panel at the Supreme Court, hearing the 2020 presidential election petition, on Monday asked General Secretary of the NDC, Johnson Asiedu Nketiah.
The panel had wanted the witness to disclose their own calculations including what the total valid votes cast in the election was, separate from the total valid votes cast in favour of the petitioner, Mr John Dramani Mahama and the second respondent, Nana Addo Dankwa Akufo-Addo.
However, Mr. Nketiah in his response to the three questions asked by the bench on the total valid votes cast figures, Mr Asiedu Nketia said he “did not know.”
Taking an opportunity to respond to these questions, lawyer Tsatsu Tsikata said the questions were irrelevant and did not form the basis of their petition and pleadings and did not also form part of the issues set out by the court for the hearing.
He said these when he was arguing for reasons why his application for inspection of original documents for the declaration of the 2020 presidential polls and declaration is granted.
He stated it would be in the interest of the EC to grant provide these documents since it would ensure transparency.
He said there is nothing to hide if the EC conduct itself properly and in a credible manner.
But the 1st and 2nd respondent objected.
It was the case of the 2nd respondent lead by lawyer Akoto Ampaw that the petitioner was trying to gather evidence for their case because it lacked any evidence for their case because that they have is not original.
He said the petitioner was pushing the burden of proof to the EC and should not be granted.
The court is yet to rule on the application.
