A member of the seven-member panel sitting on the election petition, Justice Yaw Apaw has shot down claims by Tsatsu Tsikata that his three questions asked Asiedu Nketiah the first witness under cross-examination were irrelevant.
The judge told the lead counsel for the petitioner to keep his personal opinion to himself.
This came in response to an answer by the lawyer to a question he was asked by the panel on what they would be doing with the original documents they have applied for from the Electoral Commission.
Mr. Tsikata said they would be comparing the original documents to the ones they have to establish its authenticity.
Then the other question was posed as to why they don’t see the need to tell the court what they have as their total valid votes when they are applying for the originals from the EC.
Mr Tsikata in his response said no we do not see the need because Asiedu Nketiah is not the returning officer.
He insisted that with the greatest respect the questions asked by Justice were irrelevant.
He said the questions asked were totally irrelevant to the issues that have to be dealt with.
It was at this point lawyer Akoto Ampaw raised an objection saying the submission by his learned colleague was not part of the application before the court.
The bench in response said his response was in reference to a question he was asked.
Justice Appau also responding asked Tsatsu Tsikaka to keep his opinion to himself.
Lawyer Tsikata fired back saying he did not make the submission likely insisting the questions were irrelevant because they had brought a petition before the court on the grounds of a declaration that was made purportedly about the December 7, 2020 polls.
