Chief Justice Gertrude Sackey Torkornoo has instructed Special Prosecutor Kissi Agyebeng to respond to the petition filed to have him impeached over alleged abuse of office.
Former Attorney General and Minister for Justice Martin Amidu has filed a petition seeking to remove Kissi Agyabeng as Special Prosecutor.
The petition was forwarded by President Akufo-Addo to the Chief Justice in accordance with Article 146 of the Constitution.
Mr. Amidu, who once occupied the position, alleges procurement breaches in the purchase of vehicles for the Office of the Special Prosecutor (OSP) and abuses involving judges and the administration of justice.
He is alleging violations of citizens’ rights through arrests and detentions, violations of the right to information, and improper appointments of personnel to the office.
Martin Amidu also believes a recent press conference held by the OSP to complain about judges constitutes abuse of judges and brings the judiciary into disrepute.
He further alleged that by arresting individuals such as Cecilia Dapaah and Prof. Frimpong Boateng, the Special Prosecutor abused their rights.
He also alleged a violation of the right to information when Mr. Agyabeng requested appointment letters and salary details of all OSP staff be put on a pen drive for him, as well as issues with the appointment of personnel to the office.
In a letter dated Thursday, May 16, 2024, the CJ said it was crucial for the SP to respond to the issues raised in the petition.
This, she explained, would help address the allegations in the petition.
The CJ added that the response from the SP will help in determining the appropriate course of action to be taken regarding the impeachment process.
“This is to forward to you a copy of the petition dated April 30, 2024, sent to the Office of the President, which was forwarded to the Office of the Honourable Lady Chief Justice on May 6, 2024.
“Kindly provide your comments on the matters raised to enable the Honourable Chief Justice to determine if a prima facie case has been made out,” portions of the letter said.
