Attorney General and Minister of Justice Godfred Yeboah Dame has opined that Speaker of Parliament Alban Bagbin must respect the ruling of the Supreme Court regarding his declaration of four seats in the House vacant.
He emphasised that despite the Speaker’s potential disagreement with the court’s ruling, it is essential to uphold the court’s authority.
He described the outcome of the case as a clear majority decision, and in order to ensure democratic order, the court’s order ought to be obeyed.
Reacting to the 5-2 majority decision by the court in overturning the Speaker’s directive on the four seats, he posited that the ruling of the court was emphatic and final.
He explained that there is no room for any argument or ambiguity over the ruling of the court.
“The point I am making is that whenever the court speaks, it has a clear and emphatic order. Even if it is a very narrow majority, that is the decision of the court, and that decision must be respected.”
To him, if the decision of the court is not obeyed, it will result in the degeneration of our society and the destruction of our democratic order for anybody at all to refuse to comply with the orders of the Supreme Court. That is non-negotiable, and that is something we must all respect.
He further criticised the opinion of former President John Dramani Mahama for the case to have been withdrawn and resolved between the parties.
He described it as surprising and wondered why the case should have been withdrawn when the Speaker had not shown any interest in having the matter settled out of court.
