Frank Davies, a lawyer for former finance minister Ken Ofori-Atta, has lambasted special prosecutor Kissi Agyebeng for redeclaring Ofori-Atta as a wanted person and fugitive from justice.
He accused him of overstepping his mandate by questioning medical reports that prevented the ex-minister from appearing before investigators.
Responding to the press held by the OSP on Monday, June 2, 2025, he referred to it as “theatrical” and “unnecessary”.
According to him, the Special Prosecutor appeared to be assuming the role of a medical professional.
Mr Davies maintained that the absence of his client was due to legitimate medical reasons, backed by documentation submitted to both the OSP and the Human Rights Court.
“We sent a report from the doctors to him, and the doctors’ report suggested he was unavailable for interview,” Davies said. “If it was not sent to him, would he have commented on it and say it is pointless? Does it lie in his domain to make this comment?”
“If he goes on to say that Ofori-Atta has been diagnosed with cancer, does he appreciate what that means? When did he transmogrify to be a doctor?”
On the issue of the Special Prosecutor announcing that his client would be tried in absentia, he declared “He says he’s going to try him in absentia. Has he exhausted all the legal avenues? We are all lawyers. We also know what to do.”
