A judge’s faith should not affect their rulings in any case, including same-sex cases – SC nominee

Supreme Court nominee Justice Dennis Dominic Adjei has stated that adjudicating on matters regarding same-sex issues must be grounded in law and not faith in judges presiding over the cases.

The respected judge appearing before the Appointments Committee of Parliament on Monday, June 16, 2025, judges must be guided by the Judicial Oath, which requires them not to be partial.

He noted that irrespective of a judge’s faith, when the person is wearing the judicial hat and presiding over cases, that individual must be guided by the law.

He was responding to a question he was asked about the subject and commentary made by religious groups regarding the matter.

“Honourable Chair, we talk about our faith; it could be Christian faith, Muslims. Farah, it is your faith. Then when you are in the courtroom, you have taken the judicial oath that ‘I shall not be partial irrespective of the persons involved’.

So once you put on your judicial cap, you must bear in mind that you must perform in accordance with the judicial oath that you had taken. So to me, if any matter is brought before me, whether it is same-sex or whatever, when it comes before me, I will look at the circumstances and the law, and I will give effect to the position of the law without being influenced by faith; otherwise, I will abdicate my seat as a judge,” he stated.

He went on to state that if judges are guided by their faith in adjudicating matters, it will open the floodgates for different sects of religious groups making specific demands for some judges to be appointed to preside over some cases.
