Vacation bench suit was built on deliberate lies to stall court work – A-G’s Office

The Office of the Attorney-General has sharply criticized a recent court application seeking to restrain two legal vacation judges, describing the allegations against the Chief Justice as a deliberate falsehood designed to stall judicial business.

Reacting to the proceedings, Deputy Attorney-General Dr Justice Srem-Sai revealed that the plaintiff and his legal team grounded their case on claims that the Chief Justice had handpicked specific cases for just two judges to hear throughout the ongoing legal vacation.

However, evidence presented in court by the applicant’s own legal team completely contradicted their suit. According to Dr Srem-Sai, Exhibit D tendered by the plaintiff demonstrated that the Chief Justice’s warrant was general in nature rather than tailored to selected cases. Furthermore, Exhibit E exposed the claim regarding the number of sitting judges as untrue, revealing that 29 judges—rather than two—have been assigned to hear matters during the vacation period.

Dr Srem-Sai lamented the disruption caused by the litigation, noting that despite the baseless nature of the claims, the legal maneuver successfully halted court proceedings for an entire week. He warned against the damaging impact of such tactics on the administration of justice, emphasizing the far-reaching consequences of calculated misrepresentation within the legal system.

The Plaintiff/Applicant and his lawyers built their case on the allegation that the Chief Justice has assigned some “selected cases” to two Judges to hear during the legal vacation. So, they applied for an injunction against the two Judges.

In court, however, their own evidence shows that their allegation was a deliberate falsehood. Their Exhibit D shows that the CJ’s warrant was general and not specific to any particular case. Worse is Exhibit E, which shows that as many as 29 Judges (not 2) are sitting during the legal vacation.

The point, however, is that they have succeeded in preventing the courts from working for one week. Never underestimate the power of deliberate falsehood.
