The Supreme Court has ordered Ghana’s Parliament to expunge the name of James Gyakye Quayson from its records as a Member of Parliament for the Assin North constituency.
The order of the court was a unanimous decision.
The order of the court follows a judgment of the apex court upholding an application invoking the original jurisdiction of the Supreme Court on the constitutionality of the election of James Gyakye Quayson.
The plaintiff, Michael Ankomah-Nimfah, filed the application after obtaining a judgement at the High Court in Cape Coast injuncting Gyakye Quayson from holding himself out as MP after the court ruled that he was ineligible to run for office in Ghana due to his Canadian citizenship.
The plaintiff sought relief in invoking original jurisdiction, claiming that a true and proper interpretation of Article 94(2)(a) of the 1992 constitution rendered the decision to allow Gyakye Quayson to run in the 2020 elections, and his subsequent election, null and void.
The Supreme Court’s seven-member panel’s decision bars Mr. Quayson from serving as a Member of Parliament.
Mr. Quayson was on trial for public officer deception, forgery of a passport, knowingly making a false statutory declaration, perjury, and false declaration.
