Presidential candidate of the People’s National Convention (PNC), Bernard Mornah, has served notice he will head to the Supreme Court to challenge the decision by an Accra High Court to dismiss the suit he filed over his disqualification from contesting the presidential election.
The disqualified candidate interacting with the media on Monday, October 21, 2024 stated that the Electoral Commission erred in disqualifying him from the contest.
He disclosed to the media that he has already informed his legal team of his plans to approach the Supreme Court for further interpretation of the matter.
The High Court dismissed the suit filed by the candidate, upholding the decision by the EC to disqualify him.
Presiding judge Justice Richard Appietu ruled that the presidential candidate of the PNC was not meticulous in filling out its nomination forms, dismissing Bernard Mornah’s application to overturn the Electoral Commission’s decision to disqualify him from the presidential race.
The judge ruled that Mornah’s right to be heard was not breached. He noted that evidence presented in court indicated that Mornah was informed of the errors on September 13, 2024, and asked to correct them.
Justice Appietu stated that Mornah waived his right to a second hearing by failing to address the errors. He compared this to a scenario in which an individual is informed of a hearing date but chooses not to attend, effectively forfeiting their right to be heard.
The judge added that both the PNC and Mornah should have exercised greater diligence in completing the forms.
He said given the PNC’s long history in the electoral process since 1992, they should have been more careful to avoid such mistakes.
Reacting to this, Mr. Mornah said, “The EC made mistakes on their own forms, and we are not allowed to make mistakes. The judge did not look at that, and that defies ordinary thinking. What is the error that they are talking about? Is it a data entry error that they are talking about, is it an error of composition, and how come those errors were not brought to court?
“The judge did not look at the issues that were brought before it, and I have already instructed my lawyers that this case is not ending here and we will go to the Supreme Court, and my lawyers say that they will quickly study the case.”
