Supreme Court dismisses application to halt Skytrain trial

The Supreme Court has dismissed an application for an interlocutory injunction seeking to halt the ongoing Skytrain trial involving former officials of the Ghana Infrastructure Investment Fund (GIIF).

The first accused person, former GIIF Chief Executive Officer Solomon Asamoah, filed a certiorari application seeking to quash a High Court decision that rejected his submission of no case.

Following that application, he sought an injunction to restrain the trial court from continuing proceedings and to suspend the order requiring him to open his defence.

Presiding as a single judge of the apex court on Monday (August 31, 2026), Justice Senyo Dzamefe dismissed the application.

The judge ruled that based on the affidavit evidence provided, the applicant failed to disclose a serious case to be tried, noting that the grievances raised were matters for an appeal.

The court further held that the trial judge did not act without or in excess of jurisdiction when ruling on the submission of no case, adding that the applicant failed to demonstrate that any irreparable harm would occur if the injunction was denied.

The decision allows the High Court trial to proceed as scheduled without waiting for the outcome of the certiorari application.

The High Court has set 23 September as the extended deadline for the accused persons to file their defence.

Meanwhile, the second accused person, former GIIF Board Chair Prof Christopher Ameyaw Ekumfi, has filed a repeat application for a stay of proceedings, scheduled for hearing at the Court of Appeal on 1 September.

Mr Asamoah and Prof Ameyaw Ekumfi are standing trial over allegations of authorizing a $2 million payment for a Skytrain project without board approval.
