AG to pppose Chairman Wontumi’s judgment deferral application in Samreboi mining case

The Attorney-General is set to strongly oppose an application for the deferment of judgment brought by Samuel Atta Akyea Esq., the newly appointed counsel for Bernard Antwi Boasiako, in the case of ‘Republic v Bernard Antwi Boasiako aka Chairman Wontumi & 2 Ors (Samreboi Illegal Mining Case)’.

In a 13-paragraph affidavit in opposition, deposed to by Senior State Attorney Nana Ama Prempeh and filed on Thursday, 25 June 2026, the Attorney-General’s Department firmly argues that because the accused was represented by counsel throughout the trial—with previous counsel withdrawing voluntarily rather than for cause—the proper source for the new legal team to obtain case records or briefs is the outgoing counsel, not the Court’s Registry.

The Department further contends that the decision to bypass the correct channel and instead petition the Registry is motivated by ‘mala fides’ (bad faith) and a deliberate intent to frustrate the course of justice.

Consequently, the state has prayed the Court to exercise its discretion to summarily refuse the application, arguing that granting the request would amount to endorsing an abuse of court processes and exposing the justice system to public ridicule.

The application is scheduled to be heard on Monday, 29 June 2026, at 9:00 am.
